BUSINESS VISA

You can apply as a business person under UK Immigration either: as a sole trader or as an Investor. UK Business Visas are applicable to flourishing business people and their families to extend and perform their business in the United Kingdom. There are two types of Business Visas for the UK – (i) Tier 1 (Entrepreneur) Visa and (ii) Sole Representative Visa.

Sole Representative Visa program

A sole representative’s role is to establish a commercial presence for the company in the UK in the form of a registered branch or a wholly-owned subsidiary. This Visa is granted for a maximum period of three years initially. It allows the applicant to conduct extensive market research to recognize the most profitable venture to invest in. To qualify for a Sole Representative visa, applicants must fulfill the following eligibility criteria,

  • You may hold a senior position in the company and not be a major shareholder and have full authority to make decisions on its behalf.

  • You can be recruited and employed outside the UK by company headquarters of business which is outside the UK.

  • Meet the English Language requirement with at least CEFR level A1 or having an academic qualification taught in English and is recognized by UK NARIC.

Tier 1 (Entrepreneur) Visa
The entrepreneur category is for those applicants who wish to invest in the United Kingdom by setting up or taking over and being actively involved in the running of one or more businesses in the United Kingdom. Before you can file for business immigration and to be considered as an eligible business person, you must have at least £200,000 under your direct control to use in the UK. The validity of the visa will be for three years and four months, and further leave of two years will be granted if various extension requirements are complied with.

Tier 1 – Investor visa
The Tier 1 – Investor visa program is designed for entrepreneurs who seek investment opportunities in the UK. The UK Business Visa regulations permit Tier 1 – Investor visa holders to assign substantial financial investment in the UK. The investment must be productive, be profitable to the UK economy, and contribute financial growth of the state. Visa, under this program, is granted for a maximum period of three years initially. It may be extended and eventually lead to permanent residence and UK Nationality, given that all the relevant prerequisites are fulfilled.
To qualify for a Tier 1 – Investor visa, applicants must fulfill the following eligibility criteria,

  • At least £2,000,000 in investment funds

  • Minimum 18 years of age

  • Funds should belong to you and your spouse name

  • When you apply for this visa at that time funds can be in UK or Overseas

WORK VISA

With effect from April 2011, the new UK ‘Highly Skilled’ Tier has been introduced. This type of visa has replaced the Tier 1 General Visa, which was known as the Highly Skilled Migrant Program (HSMP). The UK Border Agency has stopped accepting Tier 1 (General) applications made from overseas since 23 December 2010. Under the new Highly Skilled Tier Visa, an entry in the UK would be open for entrepreneurs, investors, and limited people under the exceptional talent category. The new Tier 1 immigration system will concentrate on businessmen and people such as top scientists, artists, and sportspersons. The General Work (Tier 2) visa allows skilled workers to enter the UK on a long-term basis to fill a skilled job vacancy; including in a wide range of skilled occupations such as IT, accountancy, teaching, or healthcare. The occupation needs to be on the Tier 2 occupation list called Tier 2 Shortage Occupation List.
